Last Minute Quarterly IFTA Filing Tips

A Quarterly IFTA tax return must be filed even if the licensee does not operate or purchase any taxable fuel in an IFTA member jurisdiction during the specific quarter. You will need to separate your mileage and fuel records for each fuel type. If you operate in New York, Kentucky, New Mexico, or Oregon you will also need to file a Weight Distance Tax Return, in each state.

What you need:
  1. Mileage log-whether you use manual trip sheets, GPS, or electronic trip sheets; it is not only necessary to have in order to file your quarterly IFTA, but you will need these if you are ever audited.
  2. Fuel Receipts-you will need to know how many gallons of fuel were purchased in each state.

Options to prepare and file your return:
  1.  Doing it yourself, you can calculate your own return by hand and mail or e-file the return. To find out the current tax rate for each state go to www.iftach.org.
  2. Using a software program that will calculate your return for you, like ExpressIFTA.com, which will reduce the chances of miscalculations.
  3. Using Truck Services of North America and let them take care of preparing and filing the return for you.

IFTA Recordkeeping Requirements

It is important to keep accurate records in case they are ever requested during an IFTA audit.  As stated in in the IFTA Procedural Manual, you are required to maintain your records for 4 years from the due date or file date of the quarterly tax return, whichever is later, plus any time period included as a result of waivers or jeopardy assessments. Records may be kept on microfilm, microfiche, or other computerized or condensed record storage system acceptable to the base jurisdiction. Non-compliance with any recordkeeping requirement may result in the revocation of the license.

Detailed distance records which show operations on an individual-vehicle basis must contain, but not be limited to:
  • Taxable and non-taxable usage of fuel;
  • Distance traveled for taxable and non-taxable use; and
  • Distance recaps for each vehicle for each jurisdiction in which the vehicle operated.
An acceptable distance accounting system is required and supporting information should include:
  • Date of trip (starting and ending);
  • Trip origin and destination;
  • Route of travel (may be waived by base jurisdiction);
  • Beginning and ending odometer or hubodometer reading of the trip (may be waived by base jurisdiction);
  • Total trip miles/kilometers;
  • Miles/kilometers by jurisdiction;
  • Unit number or vehicle identification number;
  • Vehicle fleet number;
  • Registrant's name; and
  • may include additional information at the discretion of the base jurisdiction.
Complete fuel records of all motor fuel purchased, received, and used in the conduct of its business must be maintained. Separate totals must be compiled for each motor fuel type and retail fuel purchases and bulk fuel purchases are to be accounted for separately.

The fuel records shall contain, but not be limited to:
  • The date of each receipt of fuel;
  • The name and address of the person from whom purchased or received;
  • The number of gallons or liters received;
  • The type of fuel; and
  • The vehicle or equipment into which the fuel was placed.
Retail purchases must be supported by a receipt or invoice, credit card receipt,
automated vendor generated invoice or transaction listing, or microfilm/microfiche of the receipt or invoice. Receipts that have been altered or indicate erasures are not accepted for tax-paid credits unless the licensee can demonstrate the receipt is
valid. An acceptable receipt or invoice must include, but shall not be limited to, the following:
  • Date of purchase;
  • Seller's name and address;
  • Number of gallons or liters purchased;
  • Fuel type;
  • Price per gallon or liter or total amount of sale;
  • Unit numbers; and
  • Purchaser's name
A licensee may claim a tax-paid credit on the IFTA tax return for bulk fuel only
when the bulk storage tank from which the fuel is withdrawn is owned, leased or
controlled by the licensee; the fuel is placed into the fuel tank of a qualified motor
vehicle; and either the purchase price of the fuel includes tax paid to the member
jurisdiction where the bulk fuel storage tank is located or the licensee has paid
fuel tax to the member jurisdiction where the bulk fuel storage tank is located.

Bulk fuel records must contain the following:
  • Date of withdrawal;
  • Number of gallons or liters;
  • Fuel type;
  • Unit number; and
  • Purchase and inventory records to substantiate that tax was paid on all bulk purchases.
There are specific requirements necessary to maintain accurate IFTA records and is your responsibility as an IFTA licensee. Proper recordkeeping simplifies the audit process, should you ever be audited.

2013 IFTA, NY HUT & KYU 2nd Quarter Filing Deadline Approaching!

The 2nd Quarter Filing Period for IFTA (International Fuel Tax Agreement), KYU (Kentucky Use Tax), New Mexico Weight Distance Tax, and NY HUT (New York Highway Use Tax) is now open. We want to remind you that the deadline for filing is July 31, 2013 and we encourage you not to wait until the last minute to file.

IFTA is the International Fuel Tax Agreement between the 48 contiguous States and 10 Canadian Provinces, where the member jurisdictions act cooperatively to administer and collect motor fuel use taxes.

The purpose of IFTA is to establish and maintain the concept of one fuel use license and one administering base jurisdiction for each license holder (licensee). Under IFTA, you only have to report to one state and the state allocate the fuel tax payments.  For more details see http://www.iftach.org.

We are halfway through the filing period for 2nd quarter.  The fuel taxes are due quarterly and July 31st is the deadline to file for the 2nd quarter. (April, May June).

What you need to file:
  • Mileage log
  • Fuel Receipts
  • Any IFTA correspondences pertaining to your account (if applicable)
Late Filing or Not Filing could result in the following:
  • IFTA filing (late fee) plus interest (if applicable)
  • Possible suspension of IFTA license
  • Possibility of having IRP/Apportioned Plate account affected
  • Citation from DOT if caught operating on a delinquent and or suspending IFTA license
  • Threat of having your entire transport operation shut down
The IFTA filing process may be vary slightly depending on your base jurisdiction state.

New York Highway Use Tax (NYHUT)
  • Carriers operating certain commercial motor vehicles that weigh 18,000 lbs or greater in New York are required to register and obtain NYHUT tax credentials. Once a NYHUT account has been established, carriers must file and pay mileage tax on a quarterly basis.
Kentucky Use Tax (KYU Number)
  • All commercial motor vehicles (except buses) with a gross weight of 60,000 lbs and over traveling into or through Kentucky must be registered with the state. Carriers with an active KYU Number are then required to file a quarterly return and pay mileage taxes to Kentucky. New qualifying vehicles must be listed with Kentucky prior to the vehicle entering the state. Temporary permits are also available.
New Mexico Weight Distance Tax
  • All commercial motor vehicles with a gross weight in excess of 26,000 lbs. must be registered with the state before traveling into or through New Mexico. Entrance can be paid at the port if not registered; however, it is not cost effective to pay at the port unless you travel through New Mexico only once or twice per year. Once a Weight Distance Tax account in New Mexico is established quarterly reports must be filed and mileage tax paid.
Oregon Weight-Mile Tax
  • All commercial carriers with a gross vehicle weight in excess of 26,001 lbs. must obtain a temporary or annual permit to travel into or through Oregon. Oregon does not belong to the International Fuel Tax Agreement; however, a proper tax permit must be obtained before entering this state. Heavy fines are imposed on carriers entering into Oregon without the proper credentials.
  • Oregon requires all new entrants to become bonded before permanent credentials are issued. Bonds may be placed by a Surety Company or posted with cash. The size of your fleet will determine the amount of the bond required.
If you are new and not sure what to do or would rather not have to take the time to file your IFTA, NY HUT or KYU contact Truck Services of North America today. If you would like us to take care your IFTA, we will need copies of your mileage logs and fuel receipts into our office by July 15th, to ensure the paperwork is processed by the July 31, 2013 deadline.

Reefer Fuel And IFTA?

Reefer fuel is NOT included when filing IFTA when that fuel used to power the refrigeration unit of the trailer. The reefer fuel must always be purchased on a separate fuel receipt.

Never pump reefer fuel on the same fuel receipt when fueling your power unit. This will lower your mpg and cost you more IFTA fuel tax. Also, when the auditor discovers you combined reefer fuel into your power unit fuel, you will be assessed penalties and interest on your IFTA audit.

You are entitled to a federal tax paid refund on each gallon of reefer fuel. You will need the total number of gallons of reefer fuel purchased during the tax year to complete the refund form. The IRS will send you a check for the federal tax paid on each gallon of fuel. If you failed to file for this refund, you can file back for the past 3 years to claim your refund.

You will want to check with your base jurisdiction to see how they handle reefer fuel.  In Maryland, for example, if you only have one tank that propels your vehicle and runs the refrigeration unit, then all fuel is included in IFTA.  If you have 2 separate tanks, you need to fuel separately and make sure reefer is marked on the receipt.  Do not include the reefer fuel on IFTA and you will able to get a refund by filing a claim.
