So. What Happens If I File IFTA Late?



Well. That depends on how late you are. And since there are four quarterly deadlines each year, it’s easy to forget to file IFTA. We wouldn't recommend that, though. No need to fork out more money towards taxes than you already are.

If you file IFTA one month late.

In the first month, you will be slapped with an additional fee of $50 or 10% of the tax you owe, whichever is greater. That $50 might not sound like much, but let’s put it in perspective.

The actual amount you will owe for IFTA will vary widely, depending on factors like the miles you drove in each jurisdiction and how much fuel was purchased and consumed.

So, for example, let’s say you would have owed $300 for the quarter. This is already a lot to be forking out. But after forgetting for that first month, you will be looking at another $50 penalty on top of that. After a month, you already owe $350.

If you file IFTA more than one month late

But let’s say you fail to file IFTA even longer. Well, you’re going to get another .4167% tacked on each month.
So if you forget to file IFTA for three months, you’ll owe $353.75.

2020: The Year of The Electric Semi?

Electric semi-trucks are coming soon.

Volvo and Peterbilt have already rolled out fully electric semi-trucks. Daimler and Tesla have plans to release theirs sometime in 2020.

Tesla has generated significant buzz and pre-orders from large trucking companies. Could this be the beginning of the end for fossil-fueled semi-trucks?

Some experts aren’t so sure.


The future of electric trucks: Tesla semis

For starters, Tesla has made bold claims of fully electric semi-trucks with a 500-750 mile range.

Tesla's statements about their semi-trucks have been controversial, to say the least. Competitors like Daimler say it's impossible. Martin Daum of Daimler said:

"If Tesla really delivers on this promise, we'll obviously buy two trucks: one to take apart and one to test, because if that happens, something has passed us by. But for now, the same laws of physics apply in Germany and in California."

Microsoft founder and billionaire Bill Gates also weighed in on the issue saying, “Eventually batteries might work for a truck, but it’s a far more difficult problem because the weight is a lot higher there.”

Daimler, Peterbilt, and Volvo meanwhile are all promoting day cab models with expected ranges well under 500 miles.

Daimler quotes about 250 miles, Peterbilt about 133 miles, Volvo about 186 miles.

Startups: Nikola semis & Xos Trucks

There are a number of other companies with plans extending farther into the future.

For instance, newcomer Nikola is planning both fully electric and hydrogen fuel cell semi-trucks for the near future.

The release date projected for Nikola semis is around 2022.

Xos Trucks (formerly Thor Trucks) also had plans to push out electric trucks with a 100-mile range this year, but so far there is no word on when that will actually happen.

What is the Truckers Jamboree?

Every year, the folks at the Iowa 90 Truckstop host the Truckers Jamboree. They’re located off Exit 284 on I-80 in Walcott, Iowa.

Now, this isn’t just any truck stop. In fact, it’s the largest truck stop in America!

Since 1979, this event has been a huge celebration of America’s Truckers. The Truckers Jamboree is a much-needed chance to show appreciation to the drivers who keep America running by delivering things we consume daily.

It’s also an opportunity for truckers to relax and connect with others in the truck transport industry, and a great place for families to come together and celebrate their livelihood. 

Events Happening at the Largest Truck Stop

The Truckers Jamboree started yesterday, July 11, but the festivities will continue today, July 12 and tomorrow, July 13.

Friday’s events start at 10 AM with various exhibits and Super Truck/Antique Truck displays. At 10:30 there will be a Pet Contest, followed by an Iowa Pork Chop cookout at 11!

Events continue into the night with music performances and more, ending with a fireworks display at 9 PM.

On Saturday, events kick off at 9AM. The highlights of Saturday’s Truckers Jamboree festivities include a donut wall, Trucker Olympics, and Truck Contest Awards!

Do You Need To File a Form 8849?

If you’re new to trucking the numbers used for necessary forms may be a bit overwhelming. There’s 2290s, 8849s, 4868s, 1099s, and 123s, we might be exaggerating with the 123s, but you get the gist, it’s a lot of forms and a lot of numbers to remember. We won’t bore you and got through each form 1 by 1, but we will tell you about the two most relevant ones for this filing period.

What is Form 2290?

The form that you have probably heard the most about, as of late is Form 2290. So what is Form 2290, and how does it relate to you, if at all.

Form 2290 is used to figure and pay the tax due on highway motor vehicles used. Your next question
is probably does it even apply to you, and the answer is it might. All vehicles with a taxable gross weight of 55,000 pounds or more that travel by highway is required to file a Form 2290.

After paying taxes you will be given a Stamped Schedule 1 that serves as proof of payment from the IRS. This document is important, as it is needed in order to register your commercial vehicle.

Do You Need to File Form 8849?

There are exemptions and claim suspensions that apply to some vehicles meeting certain requirements. The requirements are as follows:

  • The vehicle used 5,000 highway miles or less during the period. 
  • The vehicle is an agricultural vehicle and used 7,500 miles or less during the period.
  • The Vehicle was stolen during the period
  • The vehicle was destroyed during the period
  • The vehicle was sold during the period 

The above list leads us to the importance of Form 8849. If any of the above are true about a vehicle you owned then you must first file a Form 2290 and pay the correct amount of Heavy Vehicle Use Tax (HVUT) and then complete Form 8849.

Claims and Refunds

In order to claim credits or refunds for vehicles stolen, destroyed, sold, or only used for 5,000 miles or less and 7,500 miles or less for agricultural vehicles, the Form 8849 is required. The things you’ll need to file a Form 8849 are your name, address, details on the vehicle you are seeking a claim/refund for and your Employee Identification Number (EIN). Be sure to double-check that the EIN you are using is consistent with what the IRS has on file.

TSNA: Trucking News Update

That’s right, the next installment of the Trucking Industry Update is here - powered by Truck Services of North America. Don’t hide it; we know you’re excited. In an industry filled with ever-changing regulations and policies, we know it’s a daunting task to stay up-to-date and informed. But not to fret, that’s what we’re here for. So just like always, keep reading and we’ll get to the good stuff.

Operation Safe Driver Week:


Starting on October 18 and running through the 24th is the annual Operation Safe Driver Week, sponsored by the Commercial Vehicle Safety Alliance (CVSA). During this week, officers in the United States, Mexico, and Canada will be looking for a variety of specific violations.

The five most common violations they'll be searching for are:

  • Speeding
  • Failure to Wear a Seat Belt
  • Failure to Obey Traffic Control Devices
  • Improper Lane Changes
  • Following Too Closely

Last year during safe driver week, officers pulled over nearly 60,000 commercial vehicle and car drivers for “unsafe driving behaviors.” That’s right, almost 60,000 traffic stops across North America over a one week period. So if you want to be safe, drive safe, and don’t get pulled over next week!

Delayed Regulations:


There’s been a lot of long-awaited trucking mandates that were expected to be implemented before the end of the year: but many have now been postponed. Don’t get too excited thoughthat’s postponed, not canceled. But regardless, it looks like you’re all going to be getting just a little bit more time before you have to deal with any of these new rules.

Let’s take a look and see some of the regulations that have been delayed so far:

Speed Limiters: The official rule that would mandate speed limiters was originally expected to be issued by the end of September 2015, but now the final rule is not expected to pass until the end of 2016.

ELDs: This one isn’t going to be delayed quite as long, but the ELD rule originally expected to pass by the end of September has been pushed back until the end of October.

Entry-Level Driver Training: The new requirements for entry-level driver training may not ever be passed. Just kidding, well, kind of. The rule has already been delayed multiple times, most recently to November 15, and Congress expects that date to get pushed back even further. The reason cited for the delay is that the Federal Motor Carrier Safety Administration has had a tough time justifying it from a cost-benefit standpoint. So while this new regulation may still may be coming your way soon, there's actually a strong chance it may not be heading your way at all.

Minimum Insurance Increases: Many agencies already agreed to this rule in principle, and the FMCSA was set to issue an advanced notice of the new regulation. Instead, it appears that other regulations have moved to the top of the priority list, and this has been put on the back burner for now.

I-95 Reopens in South Carolina:


This one hit us close to home here at TSNAmerica (quite literally), and we’re excited to say that all closed sections of I-95 through South Carolina have been reopened. Earlier this week, the state DOT announced that all southbound lanes had been reopened and that bridges on the northbound lanes were still under construction. But as of now, all lanes in both directions are ready for truckin’!

Winds of Change Coming In Wyoming

Anyone traveling through Wyoming must brace for unusually strong gusts of wind that can topple an empty rig in the blink of an eye. This article will focus on gentler winds, i.e. changes in Wyoming law and attitude that are still worthy of your attention.

Wyoming made national news in April when two huge pile-ups occurred on I-80 within a single week, raising concerns about highway safety along our vast open spaces. While truckers have always known to “expect the unexpected,” Wyoming weather and abundant wildlife can surprise even the most experienced drivers! Bluebird weather one minute can change to dense fog or ground blizzards the next, and pulling off to the side of the road has its own risk as everyone else is trying to do the same. It can become one big tragic cluster in seconds.

This is why the Wyoming Highway Patrol (WHP) opposed legislative bills to raise the speed limit from 75 mph to 80 mph on long, lonely stretches of our interstate highways. The patrol reasoned that higher speeds would result in less reaction time to our unpredictable everything and urged Wyoming lawmakers not to raise the limit. Those patrol worries did not win the day. So, Wyoming motorists enjoy the higher speed limit, but the WHP is showing less tolerance for those exceeding the limit even by a few miles per hour.

Several months ago it came to light that the WHP tied raises, promotions, and bonuses to ticket quotas, setting off a firestorm of criticism that resulted in discarding such policy before lawmakers felt compelled to introduce bills to formally stop the practice. The negative public sentiment toward the WHP changed quickly after the April pile-ups as the patrol worked tirelessly in horrible conditions to rescue accident victims and clean-up the carnage for days afterward.

Newspaper photos of the scene from both accidents showed multiple mangled semis and prompted a number of letters to the editor urging truckers to drive more cautiously. What few outside the industry realize is that truckers cannot stop on a dime and are as susceptible as any other driver to sudden zero visibility.

Like the Serenity Prayer, we seek patience to accept what we cannot change, and strength to change what we must. Obviously, operators can lessen risk by making sure their equipment and their brains are in good working order and capable of handling higher highway speeds and adjusting to sudden changes in conditions.

Another wind of change in Wyoming has been greater protection for persons using non-motorized modes of transportation. During the last legislative session, a law was passed that requires motorists to allow bicyclists three feet when passing them on the roadway. This happened, mind you, when legislators were also considering whether to increase the speed limits on two-lane roads (where cross-country bicyclists are more likely to travel). If safety is a top priority, increasing the speed limit on two-lane roads may not be such a wise choice. Such a law has not yet passed.

Truckers traveling on rural roads and in town should be aware that Wyoming school buses are now equipped with video cameras, so as to more easily identify and prosecute those drivers who pass a bus that is stopped with flashing red lights. This development occurred because of the death of a little girl exiting a school bus who was hit by a passing motorist ignoring the flashing bus lights.

For several years, Wyoming law has required motorists to move to the passing lane when passing a stopped patrol car with flashing lights on the side of the road…if you can safely do so. Traffic is beyond your control but maintaining reasonable speeds to allow maneuverability is still in your control.

Wyoming lawmakers have been keenly aware of the dangers of distracted driving. Hand-held cell phone use is banned in most cities and towns, and texting while driving is forbidden everywhere in the State. Marijuana remains illegal in Wyoming but not in neighboring Colorado. I’m wondering if I’m the only one who has noticed a distinct change in the flow of traffic in Colorado since marijuana became legal. Too often now, I cross into Colorado on I-25 and see a number of drivers appearing completely unaware of how slow they are driving and what effect that is having on other motorists. Their “happy zone” is my frustration.

Another small wind of change that is of particular interest is a new Wyoming law that deals with towing abandoned or disabled vehicles. The Wyoming Department of Transportation removes vehicles when an operator cannot. Law enforcement must now choose from a rotating list of tow truck companies, something that was not done in the past.

Lastly, truckers whose native language is not English, should be aware of English Comprehension Examinations that, by law, WDOT personnel can administer at a Port of Entry if they have reason to believe that the trucker does not have a sufficient grasp of the English language in order to understand roadway signs and signals. Unfortunately, the results of the test may be considered “passing” by one patrolman at the Port of Entry on the eastern border of Wyoming, while the same test with the same results by the same trucker on the western border is considered “failing” by a different WDOT grader. The subjective nature of this makes it vulnerable to criticism as patently unfair. The ACLU has raised a number of objections and concerns about this test in recent years but the ACLU just closed its Wyoming office so will no longer be around to try to right this wrong.

As you can see, Wyoming laws and attitudes have changed only slightly this year. People in this State are generally grateful for all that the trucking industry and individuals bring to us. By constantly expecting the unexpected, you will be doing your part to prepare for and adjust to those wild, windy things you cannot change or control.

Breaking News: New Trucking Regulations

So far this summer has been an uncharacteristically busy one for the trucking industry. It seems like just about every week the Senate is passing a new transportation bill, and it can be a daunting task to keep up with all the new rules and regulations.

But that’s what your friends at TSNAmerica are here for, so take a look below and we’ll go over all the new mandates and bills that have been passed recently or will be coming soon.

Trucking Updates


So far this summer, these are the new mandates and bills that have been either passed or proposed.

Speed Regulator Law:

A newly proposed bill would require the use of speed limiters on heavy trucks is set to be published by the Department of Transportation this week. Details of the bill have not been made public yet, but the bill is expected to pass through the White House and be published by the National Highway Traffic Safety Administration later this week. However, the bill is expected to include the proposed speed limit and also whether or not the rule will be applied to trucks that are already in use.

E-log Mandate:

Also this week, the final version of the Federal Motor Carrier Safety Administration’s rule that would make the use of electronic logging devices mandatory is supposed to be finished. The rule will not actually take effect until two years after its publication in the Federal Register, but it will require all drivers that must keep duty records to use an electronic logging device.

The rule is currently under review by the Office of Management and Budget, although it is expected to be cleared next month on September 21 and published by September 30. in addition to this rule, a corresponding rule.

DRIVE Act:

Also within the last month, the DRIVE Act, which stands for Developing a Reliable and Innovative Vision for the Economy, was approved by the US Senate with a vote of 65 to 34. This is big news for trucking because let’s face it, we all know the highways across our country could use some work. The bill comes at a big time for the industry, as over the last several years 34 short-term extensions have been passed to extend the current method for highway funding, which has proven to be ineffective. The new bill will put over $350 billion into the funding of our nation’s highways, railroads, and public transit systems. While the sponsors of the bill were only able to guarantee the bill’s first three years, the bill is still a huge step forward for the industry.

New Transportation Bill:

In addition to the aforementioned DRIVE Act, the Senate has also been working on another transportation-related bill. Although it’s been 22 years since the last time taxes were raised as an act of Congress, it’s looking more and more likely that those 22 years will be coming to an end soon.

Senator Tom Carper from Delaware announced the TRAFFIC Relief Act of 2015, which would increase fuel taxes by four cents each year for the next four years in order to offset years of inflation. The money would go towards the highway trust fund, and the proposal would index taxes to the rate of inflation after four years and would make a pair of earned income tax credits permanent.

1st Quarter IFTA Filing Period Now Open: Get Ready for April 30th


It’s the circle of life.

One thing ends, and another begins. As the first IFTA quarter has closed, now the filing period opens and the second quarter begins!

Luckily, your friends at TSNAmerica can help you with both! We have IFTA Filing services at a range of price points to suite everyone’s needs. Plus we can help ensure that you start off the 2nd quarter on the right foot!

Were your recordkeeping practices in Quarter 1 lax at best? Give us a call, and we’ll be happy to walk you through best practices for IFTA recordkeeping. 

Here are a few highlights to keep in mind as we move into Quarter 2:

1. Record your mileage per jurisdiction and fuel purchases–every single day. It’s much easier to spend just 3 minutes a day on Trip Sheets instead of hours or days at the end of the quarter.

2. Use a program like TruckLogics to record your trip details. You can then print and mail these to us, and we’ll use them to calculate your tax and prepare your return.

3. Keeping up with records also reduces errors, and therefore, reduces your risk of an IFTA audit.

4. IFTA records must be retained for at least 4 years after the filing date. Store them in your base jurisdiction so that they’re readily available in the event of an IFTA audit.


Now for the tricky part– upcoming deadlines!


  • 1st Quarter IFTA returns are due by Thursday, April 30th! TSNAmerica can prepare your return for you based on your trip sheets AND file it directly with your base jurisdiction. While we do our best to accommodate last-minute filing emergencies, we file on a first-come, first-served basis, so don’t wait until the 29th to get in contact with us!

BOC-3 Filings: What You Need to Know Before You File Yourself


UCR, IFTA, IRP, MC#, DOT#–the list goes on and on!

Obtaining your operating authority requires filing all of the above and more, making this task a time-consuming nightmare for new transportation companies.

But nothing is more arduous than filing your own BOC-3.

The BOC-3, or blanket of coverage, is also required to obtain your interstate operating authority, and it is typically filed immediately after your MC# is issued.

Submitted to the FMCSA, the BOC-3 filing is used to designate process agents in each state your business operates in or through.

Each process agent serves as your legal representative in that state and accepts all legal documents or court papers that may be served to your business. The agent, in turn, sends those documents to you, and if the agent is a lawyer, they may advise you on how to proceed appropriately and according to laws in that state.


Ways to File your BOC-3


Here’s where it gets tricky! Should you decide to file the BOC-3 on your own, you must obtain the contact information and consent for an agent in each state you operate in. Moreover, the agent cannot be just anyone. For example, the agent must reside in the state for which s/he is designated. It’s also best that the agent be a lawyer for the reason stated above. For more information on who can serve as an agent, check the FMCSA regulation 49 CFR 366.

Alternatively, you can have a processing agent file your BOC-3 for you. But be cautious when choosing your processing service. The agent must be registered with the FMCSA as a BOC-3 blanket agent. This means they have already leased the services of an agent in all states, which is itself a difficult task that many agents have not completed. Moreover, many processing services will take 3-7 days to complete your BOC-3, which means your MC# will not be activated and you cannot operate.


Change Happens


  • Changes in designation can only be made by filing a new BOC-3 with the FMCSA. If you have an existing BOC-3, but would like to alter one of your designations.
  • If any of your contact information changes, even slightly, you are legally obligated to notify your blanket agent. This is to ensure that any legal documents served to your business can be promptly delivered. 3rd Quarter IFTA Deadline: A Cautionary Tale for Late Filers

With 6 A.M. came the mingling of the lights. That brief moment when Night and Day dance together, one inevitably yielding to the other. The creeks and hums of Night slowly giving way to the first stirrings of morning.

And as that first bit of dawn leaked through the curtains of his cab window, Bobby’s alarm suddenly awoke him with an ear-piercing chord.

He stirred from his slumber to silence his phone with a *smack.*

It was just another day on the road for Bobby… or so he thought. But this day’s events would turn out to be far more sinister.

As he rubbed his eyes and glanced at his phone, a small reminder popped up: “IFTA Due Today.” His heart beginning to thump wildly, he glanced at his calendar to see the cold, hard truth of it.

It was October 31st, 2014, the Day of the Deadline.

Bobby often thought about the approaching third quarter IFTA deadline, but his thoughts were quickly diverted by more pressing matters. 

Upcoming maintenance on his truck. Delivering his cargo on time. Desperately seeking a few solid hours of rest. 

Bobby, like so many others, assumed he’d get around to IFTA later. And later never came.

Accepting the harsh reality, Bobby sprung from his bed, one hand buttoning his shirt, the other rummaging around for a shoe box filled with fuel receipts.

He retrieved the box, and slowly pried off the lid to reveal its horrifying contents.

Dozens of receipts, old and new, twisted and writhing upon one another like a fistful of worms. Many illegible. Many more missing.

Bobby knew he needed original receipts for all fuel purchases. “Now is not the time to panic,” Bobby repeated to himself. But it was futile. Panic already had Bobby is his steely grip, and the grip was getting tighter each second.

Beginning to lose hope, Bobby grabbed his incomplete trip sheets, powered up his laptop, and began typing them up, line by line.

Minutes became hours. And each hour felt the length of an eternity.

Squinting at the screen with his heavy eyelids, Bobby’s bloodshot eyes suddenly grew wide as he noticed the time. The deadline had passed, and Bobby’s IFTA filing was late. Again.

This wasn’t the first time Bobby missed the deadline. He was all too familiar with late filing penalties. So he carried on, knowing that the sooner he filed, the better.

Racing to finish, he filled in the gaps on his trip sheets the best he could. He “guest-imated” his fuel use based on a standard MPG. But in his haste, Bobby made these dire mistakes–and many more. Mistakes that would cost Bobby dearly.

Months had passed, and Bobby had almost forgotten that fateful night. Until one brisk evening, he sat alone and exhausted in the quiet of his cab.

The phone rang.

Bobby, startled, peered over to his phone to see who was calling. It was an unfamiliar number he’d never seen before.

He reached over and slowly raised the phone to his ear. “Hello?” Bobby croaked.

Nothing.

“Hello?” he said more loudly. Still nothing. Sleep deprived, he wondered if he’d imagined the phone ringing. Just as he went to hang up, he heard someone on the other end. Breathing.

“Hello!” he said a third time, crazed with anticipation! The menacing breath quickened.

Finally, a somber voice spoke. “Mr. Hawkins, good evening. I’m calling to notify you...you’ve been selected for an IFTA audit.”

The phone slipped from Bobby’s hand. Stricken with shock, he sat staring blankly at the floor. He knew he’d gone too far. He knew his day of reckoning had come. And he wondered how he could’ve done things differently.

“If only I’d been more prepared,” he lamented. If only he’d known about TSNAmerica.

File Form 2290 Same Day via Phone

Form 2290, also known as Heavy Vehicle Use Tax, is filed annually with the IRS. Taxes are paid on any vehicles registered in your name that have a gross weight of 55,000 pounds or more and that will travel at least 5,000 miles on public roads during the tax period. The tax year for heavy vehicles begins on July 1st, and the filing due date for renewals is the end of August.
