February 28th 2290 Deadline for Vehicles First Used in January 2014


Deadline to file your Form 2290, if you first placed your vehicle on the road anytime during the month of January, is tomorrow!

A Vehicle is considered to be a taxable vehicle if it was operating on public roads between the tax periods of July through June. A vehicle is also considered to be taxable if it has a taxable gross weight of at least 55,000 pounds and travels at least 5,000 miles during the tax period (7,500 miles if used for agriculture).

Form 8849-Claim For Refund of Excise Taxes


If you sell a vehicle after you have filed your Form 2290 Return, you would need to file Form 8849, Schedule 6 in order to claim your credit.  You would also use Form 8849 if your vehicle was stolen, destroyed or for any vehicle on which the tax was paid on Form 2290 if the vehicle was used 5,000 miles or less on public highways (7,500 or less for agricultural vehicles) during the tax period (July 1–June 30).

File Form 2290 By Phone


Form 2290 is used to file Heavy Vehicle Use Tax for taxable vehicles. A Vehicle is considered to be a taxable vehicle if it was operating on public roads between the tax periods of July through June and if it has a taxable gross weight of at least 55,000 pounds and travels at least 5,000 miles during the tax period (7,500 miles if used for agriculture).

Heavy Vehicle Use Taxes must be filed using the Form 2290 on an annual basis. The Tax period for Heavy Vehicles begins on July 1st and ends on June 30th of the following year. The annual renewal of your Form 2290 for a new tax period IS DUE BY August 31st each year.

For new vehicles placed in service, the IRS Form 2290 must be filed by the last day of the month following the month of first use. For example, if you purchase and first use a vehicle in September, you must file a Form 2290 by the end of October.

What is an EIN?


An EIN is an Employer Identification Number, also known as a Federal Tax Identification Number, and can be used to verify a business entity. An EIN is usually required in order to file a tax return for a business. If you are filing Form 2290 for Heavy Vehicle Use Tax (HVUT), you must have an EIN to file the return. The IRS no longer accepts Social Security Numbers for the Form 2290.

If you need to file Form 2290 for vehicles first used in January, the due date to file is February 28, 2014. If you do not have an EIN, Truck Services of North America take can obtain one for you. We will be able to get your EIN immediately, but it may take the IRS up to 10 business days to update new EINs into their system; so you need to get your EIN today!

Form 2290 Suspended Vehicles

If a highway motor vehicle does not exceed mileage 5,000 miles or less (7,500 miles or less for agricultural vehicles) it is considered suspended and is exempt from tax. Mileage use limit means the use of a vehicle on public highways 5,000 miles or less (7,500 miles or less for agricultural vehicles). The mileage use limit applies to the total mileage a vehicle is used during a period, regardless of the number of owners.


An agricultural vehicle is any highway motor vehicle that is:

  1. Used (or expected to be used) primarily for farming purposes, and
  2. Registered (under state laws) as a highway motor vehicle used for farming purposes for the entire period. A special tag or license plate identifying the vehicle as used for farming is not required for it to be considered an agricultural vehicle.


So why would do you have to file if there is no tax due?  In order to obtain your registration and/or tags, state require and Stamped Schedule 1 from the IRS for all vehicles 55,000 lbs or more.  You must file Form 2290 in order to receive your Stamped Schedule 1.

2290 Filing Deadline For Vehicles First Used in January 2014

If you first placed your vehicle on the road anytime during the month of January, you must file your Form 2290 by February 28, 2014. If a vehicle was used during any part of a month, the tax will be calculated for that month as a whole. For example, if a vehicle was used on January 20th, it will be taxed as though it was used the entire month.  


The tax will be prorated based on the number of months the vehicle will have been used during the tax year. So vehicles that were placed in service during the month of January will need to file HVUT using the Form 2290 by February 28, and the tax will be based on 6 months, instead of the full year.


While the deadline is the last day of the following month, you may need to file your Form 2290 before the deadline in order to get or renew your IRP plates.  Many states require a stamped Schedule 1 as proof that your 2290 was filed before they will issue or renew your plates.

EIN Is Mandatory To File Form 2290


An Employer Identification Number or EIN, is also known as a Federal Tax Identification Number, and is used to identify a business entity.  According to IRS website, you are required to have an EIN if any of the following are true:
  • You have employees
  • You operate your business as a corporation or partnership
  • You file any of these returns: Employment, Excise, Alcohol, Tobacco and Firearms
  • You have a Keogh plan
  • You withhold taxes on income, other than wages, paid to a non-resident alien
  • You are involved with any of the following types of organizations:
    • Trusts, excepts certain grantor-owned revocable trusts, IRAs, Exempt Organization Business Income Tax Returns
    • Estates
    • Real estate mortgage investment conduits
    • Non-profit organizations
    • Farmers’ cooperative
    • Plan administrators

For vehicles 55,000 lbs or more, first put on public highways in December, then you are required to file a Form 2290 Return, by January 31, 2014.  IRS Form 2290, used to file Heavy Vehicle Use Tax (HVUT), is considered an excise tax, so you would be required to have an EIN.  Be advised that it can take the IRS up to 10 business days to get new EINs into their system, so you will want to get your EIN today, in order to file Form 2290 on time.
