Form 2290 Suspended Vehicles

If a highway motor vehicle does not exceed mileage 5,000 miles or less (7,500 miles or less for agricultural vehicles) it is considered suspended and is exempt from tax. Mileage use limit means the use of a vehicle on public highways 5,000 miles or less (7,500 miles or less for agricultural vehicles). The mileage use limit applies to the total mileage a vehicle is used during a period, regardless of the number of owners.


An agricultural vehicle is any highway motor vehicle that is:

  1. Used (or expected to be used) primarily for farming purposes, and
  2. Registered (under state laws) as a highway motor vehicle used for farming purposes for the entire period. A special tag or license plate identifying the vehicle as used for farming is not required for it to be considered an agricultural vehicle.


So why would do you have to file if there is no tax due?  In order to obtain your registration and/or tags, state require and Stamped Schedule 1 from the IRS for all vehicles 55,000 lbs or more.  You must file Form 2290 in order to receive your Stamped Schedule 1.

June 30th Form 2290 Deadline for Vehicles First Used in May 2013


Reminder: Deadline to file your Form 2290, if you first placed your vehicle on the road anytime during the month of May is June 30th.

A Vehicle is considered to be a taxable vehicle if it was operating on public roads between the tax periods of July through June. A vehicle is also considered to be taxable if it has a taxable gross weight of at least 55,000 pounds and travels at least 5,000 miles during the tax period (7,500 miles if used for agriculture).

Reminder: Form 2290 HVUT Deadline Today

Today is the last day to file your Form 2290, if you first placed your vehicle on the road anytime during the month of April.

A Vehicle is considered to be a taxable vehicle if it was operating on public roads between the tax periods of July through June. Form 2290 Deadline Coming

The deadline would normally be, March 31, 2013 to file Form 2290 for Heavy Vehicle Use Taxes for any vehicles that were first placed on public highways during the month of February.  But since that day falls on a Sunday this year, you will have an extra day to file your Form 2290.

Form 2290 Deadline for Vehicles First Used in November 2012


If you first placed your vehicle on the road anytime during the month of November, you must file your Form 2290 by December 31, 2012. If a vehicle was used during any part of a month, the tax will be calculated for that month as a whole. For example, if a vehicle was used on November 20th, it will be taxed as though it was used the entire month.  

The tax will be prorated based on the number of months the vehicle will have been used during the tax year. So vehicles that were placed in service during the month of November will need to file HVUT using the Form 2290 by December 31st, and the tax will be based on 8 months, instead of the full year.

While the deadline is the last day of the following month, you may need to file your Form 2290 before the deadline in order to get or renew your IRP plates.  Many states require a stamped Schedule 1 as proof that your 2290 was filed before they will issue or renew your plates.

Next Friday is the Form 2290 Deadline For Vehicles First Used in October

Reminder, if you first placed your vehicle on the road anytime during the month of October, you must file your Form 2290 by November 30, 2012. If a vehicle was used during any part of a month, the tax will be calculated for that month as a whole. For example, if a vehicle was used on October 15th, it will be taxed as though it was used the entire month.

2013 UCR Registration & NY HUT Renewals Begins Today

2013 Unified Carrier Registration opens today.  The deadline to register is December 31, 2012.  The Unified Carrier Registration (UCR) Plan and Agreement are part of a Federally-mandated, State-administered program that went into effect September 10, 2007.  Under this program, States collect fees from motor carriers, motor private carriers, freight forwarders, brokers and leasing companies, based on the number of qualifying commercial motor vehicles (CMVs) in their fleets. The revenues generated will be used for enforcement of motor carrier safety programs.

Who is Subject to UCR?  
All motor carriers (for-hire, private and exempt) – as well as brokers, freight forwarders, and leasing companies operating in interstate or international commerce are subject to the new UCR.   Entities based in Canada and Mexico that are involved in interstate or international commerce in the United States are also subject to UCR.  

Also beginning October 1, 2012 the renewal period begins for the New York State imposed a highway use tax (HUT) on motor carriers operating certain motor vehicles on New York State public highways (excluding toll-paid portions of the New York State Thruway). The tax is based on mileage traveled on NYS public highways and is computed at a rate determined by the weight of the motor vehicle and the method that you choose to report the tax.
Beginning January 1, 2013, you must affix a decal to each vehicle that's required to have a certificate of registration.
Vehicle registration requirements
You must obtain a certificate of registration for each vehicle subject to HUT. There are two types:

  • A HUT certificate of registration is required for any truck, tractor, or other self-propelled vehicle with a gross weight over 18,000 pounds. (If you elect to use the unloaded weight method to file your returns, a certificate is required for any truck with an unloaded weight over 8,000 pounds and any tractor with an unloaded weight over 4,000 pounds.)
  • An automotive fuel carrier (AFC) certificate of registration is required for any truck, trailer, or semi-trailer transporting automotive fuel. (The same gross weight and unloaded weight rules apply.)
You are also required to file your quarterly highway use tax return.  The quarters are based on calendar quarters, so September will mark the end of the 3rd Quarter and the deadline to file is October 31, 2012.
